These Terms & Conditions (“Terms”) govern your access to and use of the Madness Rush website and game (together, the “Game”), operated by NeoArcade Games (“we”, “us”). By using the Game, you agree to these Terms.

1. License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Game for your own personal, non-commercial entertainment, subject to these Terms.

2. Account & Sign-Ups

Beta access and newsletter sign-ups are provided on an as-available basis. We may limit, suspend, or end the private beta at any time without notice.

3. Premium Purchases & Promo Codes

• Premium unlocks additional content for a one-time price, currently displayed at checkout (e.g. $7.99), subject to change.
• Promo codes are single-use unless stated otherwise, may have an expiration date or maximum redemption count, and may be disabled or revoked at our discretion in cases of abuse.
• All purchases made through the Apple App Store or Google Play are also subject to that platform’s own terms and refund policies.

4. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Game, except where permitted by law.
• Use cheats, bots, exploits, or unauthorized third-party software to gain an unfair advantage.
• Attempt to disrupt, overload, or gain unauthorized access to our servers or Firestore database.
• Resell, redistribute, or commercially exploit the Game or promo codes without our written consent.

5. Intellectual Property

All characters, artwork, code, trademarks, and other content in the Game are owned by NeoArcade Games or its licensors and are protected by copyright and other intellectual property laws.

6. Disclaimer of Warranties

The Game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, NeoArcade Games shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Game.

8. Termination

We may suspend or terminate your access to the Game at any time, for any reason, including violation of these Terms, without prior notice.

9. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Game after changes are posted constitutes acceptance of the revised Terms.
